MP Reid Signs On to Fight US Court Battle for Canada’s Beef Industry

May 2, 2005

Ottawa – Local MP Scott Reid has signed on to the Conservative Party’s petition to receive “Intervenor Status” in a Montana court in order to overturn a court injunction that has prevented the US border from re-opening to exports of live Canadian cattle.

On March 4, 2005-only days before the scheduled full opening of the U.S. border to Canadian cattle-a judge in Montana accepted the argument of a protectionist American cattlemen’s lobby group, and granted a temporary injunction prohibiting the U.S. Administration from opening the border. The full hearing on a permanent court order is scheduled for July 27, 2005.

Courts permit outside parties to seek two kinds of standing in a proceeding before the court. The first is “Intervenor” status, where the outside party is a participant in the proceedings of the court. The second form of standing is “Amicus” status, where the outside party is only permitted to make a written deposition but is not permitted to offer testimony or participate in the proceedings. In April, the Liberal government chose to seek only the lesser “Amicus” status before the Montana court.

“Considering the gravity of the case for Canadian farmers, and the fact that the court will be finding on the integrity of the Canadian national beef inspection regime, I am amazed that the Liberal agriculture minister is being so passive,” Reid observed, in explaining why he and more than thirty other Conservative MPs have decided to seek Intervenor status. “The Conservative Party has been working hard for almost two years to get the Liberals to make the BSE crisis a top priority. Sometimes I wonder whether the Liberals care about Canadian agriculture at all.”
